Terms of Service

The Site is informational. Nothing on it is an offer to sell, a binding quotation, a product specification, a warranty, or a commitment to develop or deliver anything. Any supply of software, hardware, integration, or services is governed by a separate written agreement signed by both parties. If anything on the Site conflicts with that agreement, the agreement controls.

Some material on the Site, including content presented under the names SENTINEL and VANGUARD, consists of concept demonstrations. Concept material illustrates a proposed workflow or a capability under development. Concept material does not depict a product currently available for purchase, lease, license, or deployment; does not depict tested, validated, or certified performance; may include simulated, staged, edited, or rendered sequences; and does not represent that any regulatory approval, airworthiness determination, waiver, or authorization has been obtained.

Where the Site labels the stage of a capability, for example in testing, in pilot, or under exploration, that label is part of the description and should be read with it. Performance figures, specifications, timelines, and roadmaps anywhere on the Site are estimates based on present expectations and are subject to change without notice. Statements about our plans and intentions are not guarantees, and we are not obliged to update them.

Nothing on the Site is engineering, airworthiness, flight-safety, legal, or regulatory advice, and nothing on it should be relied on in planning or conducting an actual operation. If you operate or intend to operate unmanned aircraft, you are solely responsible for complying with all applicable requirements, including in the United States, FAA regulations and any required waivers or exemptions, and applicable state and local law, and with equivalent rules elsewhere, and for your own safety assessment, risk analysis, and operating limits.

The Site and its contents are owned by Kuiper Lab or our licensors. You may view the Site and print or download individual pages for your own internal reference. You may not copy, republish, redistribute, frame, mirror, scrape, or create derivative works from the Site or its content, or use it to train machine learning models, without our prior written permission. Downloadable materials such as spec sheets may be shared within your organization for evaluation, but not published, sold, or distributed outside it.

"Kuiper Lab," the Kuiper Lab logo, and program names are our trademarks. Other company, product, and platform names belong to their respective owners; referring to a third party does not imply endorsement, affiliation, or any commercial relationship unless the Site expressly says otherwise.

Anything you send us through the Site or by email is not confidential unless a signed confidentiality agreement covers it, and we may use it for any purpose, including improving our products, without obligation or compensation to you. You confirm you have the right to send it. Do not send us confidential information, trade secrets, export-controlled technical data, or classified material through the Site or by ordinary email; contact [email protected] first. We do not accept unsolicited ideas, inventions, or product proposals; if you send one anyway, this section applies to it. Materials sent to [email protected] are handled under our Privacy Policy. Applying does not create an employment relationship or any obligation to respond, interview, or hire.

Technology in our field may be subject to export control and sanctions laws, including the U.S. Export Administration Regulations (EAR) and, where applicable, the International Traffic in Arms Regulations (ITAR), and to sanctions administered by the U.S. Office of Foreign Assets Control (OFAC) and comparable authorities elsewhere. By using the Site you represent that you are not located in, ordinarily resident in, or organized under the laws of a country or region subject to comprehensive U.S. sanctions or embargo; that you are not on the Denied Persons List, Entity List, SDN List, or any equivalent restricted-party list; that you will not access, download, export, re-export, or transfer material from the Site in violation of those laws; and that you will not use material obtained from the Site in connection with any prohibited end use, including weapons of mass destruction, unlawful surveillance of individuals, or any activity violating applicable human rights or privacy law.

The Site links to and embeds content from services including LinkedIn, YouTube, and Instagram. We do not control them and are not responsible for their content, availability, or practices. Following a link is at your own risk and subject to that service’s terms.

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any content is accurate, complete, or current. Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, KUIPER LAB AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules, and you and Kuiper Lab agree to the exclusive jurisdiction of the state and federal courts in Suffolk County, Massachusetts. We may update these terms; the current version is always posted with the date above, and continuing to use the Site means you accept it. If any provision is held unenforceable the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them to a successor in a merger, acquisition, or sale of assets. These terms and the Privacy Policy are the entire agreement between you and Kuiper Lab regarding the Site.
